GIVEN TODAY'S TOPIC.\nDOMESTIC WORKERS CLEAN HOMES,\nLANDSCAPE TO SUPPORT ELDERS,\nWORK THAT QUITE LITERALLY MAKES\nALL OTHER WORK POSSIBLE. ALL OF\nTHAT WHILE BEING WRITTEN OUT OF\nTHE VERY LABOR LAWS THAT WERE\nSUPPOSED TO PROTECT WORKERS. AND\nTHAT WASN'T AN ACCIDENT. WHEN\nTHE FAIR LABOR STANDARDS ACT\nPASSED IN 1938 DOMESTIC WORKERS,\nFARMWORKERS AND HOME HEALTHCARE\nWORKERS WERE DELIBERATELY\nEXCLUDED. A CONCESSION TO\nSOUTHERN DEMOCRATS IN CONGRESS\nCARVING OUT THE JOBS DONE ALMOST\nEXCLUSIVELY ENTIRELY BY BLACK\nAND LATINO WORKERS AND THAT\nSHAPED LABOR LAW IN THIS COUNTRY\nFOR DECADES. BUT SEATTLE DECIDED\nTO DO SOMETHING ABOUT IT. AND IN\nJULY 2018 SEATTLE BECAME THE\nFIRST CITY IN THE COUNTRY TO\nPASS A DOMESTIC WORKERS BILL OF\nRIGHTS. AND THANK YOU TO COUNSEL\nMEMBER JUAREZ FOR HER WORK ON\nTHAT LEGISLATION. THIS\nLEGISLATION WAS NOT JUST MINIMUM\nWAGE PROTECTIONS BUT SOMETHING\nMORE AMBITIOUS. A DOMESTIC\nWORKERS STANDARDS BOARD.\nWORKERS, EMPLOYERS AND COMMUNITY\nREPRESENTATIVES AT A TABLE\nTOGETHER WITH THE POWER TO\nEFFECTIVELY ADVISE ON INDUSTRY\nSTANDARDS. THAT IS A NEW IDEA.\nSEATTLE SAID THE PEOPLE THAT DO\nTHIS WORK SHOULD HAVE A VOICE IN\nSHAPING THE CONDITIONS OF THAT\nWORK. AND THAT'S WHAT THAT\nBOARD IS. I MET SOME OF OUR\nPANELISTS THAT WE WILL HEAR FROM\nTODAY AT THE ANNIVERSARY\nCELEBRATION FOR DOMESTIC WORKERS\nBILL OF RIGHTS JUST ABOUT TWO\nYEARS AGO. REPRESENTATIVE\nBREANNA THOMAS FROM THE 34th\nLEGISLATIVE DISTRICT HEALING\nFROM WEST SEATTLE WHO HELPED\nWRITE THE WORKER PROTECTIONS IN\nTHE CITY MODELED THE STATE\nLEGISLATION AND HER WORK\nALONGSIDE SENATOR HAILING FROM\nTHE 37th DISTRICT WHO INTRODUCED\nTHE BILL LAST YEAR, THESE TWO\nWORKED OVER THE PAST TWO YEARS\nTO GET IT DONE AND JUST LAST\nMONTH GOVERNOR FERGUSON SIGNED\nHOUSE BILL 2355 INTO LAW\nENSURING THAT NANNIES,\nHOUSEKEEPERS, HOMECARE PROVIDERS\nAND OTHER DOMESTIC WORKERS\nACROSS WASHINGTON STATE RECEIVE\nFAIR PAY, WRITTEN AGREEMENTS,\nPRIVACY PROTECTION, LEGAL\nRESOURCES, RIGHTS, THEY HAVE\nBEEN DENIED FOR DECADES. IT IS\nTHE 16th DOMESTIC WORKER\nSTANDARDS BILL OF RIGHTS PASSED\nIN THE UNITED STATES. SO THIS\nWORK THAT WE ARE GOING TO HEAR\nFROM CONTRIBUTED TO THAT. EVERY\nRECOMMENDATION THEY HAVE MADE,\nEVERY CONVERSATION THAT\nHAPPENED, THAT IS A PART OF WHAT\nMADE THIS STATEWIDE BUILD NOT\nJUST POSSIBLE BUT NECESSARY. HIS PROFESSIONAL\nBACKGROUND REALLY RANGES FROM\nBUSINESS CONSULTANT AND\nNONPROFIT DEVELOPMENT,\nCOMMUNICATIONS, MISMANAGEMENT,\nHE HAS BEEN PART OF A DIFFERENT\nADVISORY BOARDS AND AN INVOLVED\nPARTICULARLY WITH THE DOMINICAN\nASSOCIATION OF WASHINGTON STATE,\nAN ORGANIZATION HE FOUNDED IN\nSEATTLE. SUPPORT THE NETWORK,\nAGAIN REALLY CONNECTING WITH THE\nLGBTQ COMMUNITY. WE ARE TALKING ABOUT\nA WORKFORCE THAT HAS BEEN\nHISTORICALLY EXCLUDED AT THE\nNATIONAL LEVEL. PROTECTION SET\nALL OTHER WORKERS ALREADY HAVE\nAND HAVE HAD FOR CLOSE TO 100\nYEARS. AND THIS AGAIN IS ROOTED\nIN MISOGYNY, SEXISM AND RACISM\nAND ALSO ANTI-IMMIGRANT. AND HAVE LED\nINTO LOW COMPLAINT RATES IN OUR\nOFFICE. AND THAT IS CONSISTENT\nWITH WHAT THE STATE WE HAVE SEEN\nAT THE STATE LEVEL. TWO REMEDY\nTHEIR SITUATION. SO WHAT WE DID\nIS THE PARTNERSHIP OF THE\nDOMESTIC WORKERS STANDARDS BOARD\nIS WE REALLY WANTED TO ASK\nOURSELVES WHAT DOES SUCCESS LOOK\nLIKE OR HOW CAN WE MEASURE OUR\nIMPACT BEYOND CASES. THE COUNCIL THEY\nGAVE MORE GRANTS FOR THESE\nORGANIZATIONS FOR DOMESTIC\nWORKERS SO THEY COULD GET MORE\nOUTREACH AND EDUCATION FOR MORE\nOF THE DOMESTIC WORKERS AND ALSO\nTHE HIRING ENTITIES.\nTHE SECOND RECOMMENDATION WAS: THE SECOND RECOMMENDATION WAS\nTO PROVIDE MORE MATERIALS AND\nRESOURCES FOR THE ORDINANCE OF\nDOMESTIC WORKERS FOR THEM TO\nCONTINUE DOING MORE OUTREACH AND\nEDUCATION. ALSO WE GOT MORE\nFLYERS, INFORMATION, VIDEOS,\nMORE PROMOTIONAL STUFF WITH THE\nGRANT ABOUT THE DOMESTIC WORKERS\nORDINANCE AND ALSO ON THE RADIO.\nWE HAVE A LOT OF ADS ON THE\nRADIO. THE THIRD ONE WAS TO\nESTABLISH BENEFITS FOR ALL THE\nDOMESTIC WORKERS. THE OFFICE OF\nLABOR STANDARDS OLS IN A\nPARTNERSHIP WITH MEMBERS OF THE\nCOMMUNITY AND THE PUBLIC GOOD.\nTHEY PUBLISH AND RESULTS IN\n2025. MAC. AND\nI THINK THAT IS COMING THROUGH\nIN TERMS OF WHAT YOU SEE AROUND\nTHINGS LIKE LANGUAGE JUSTICE,\nACCESSIBILITY, INCLUSIVITY AND\nTHE ABILITY TO ACTUALLY ATTACK\nAFFECT CHANGE. PARTICULARLY OVER\nTHE LAST FEW YEARS ANY SORT OF\nWORK AROUND IMMIGRANT RIGHTS AND\nWORKER RIGHTS AT THE NATIONAL\nLEVEL HAS BEEN SO DIFFICULT. THE\nWORK WE ARE DOING IN THE CITY\nHAS A TANGIBLE, REAL IMPACT ON\nPEOPLE'S LIVES AND NOT ONLY FOR\nWORKERS BUT I THINK THE DOMESTIC\nWORKER MOVEMENT IS ONE OF THE\nFEW TRULY CROSS CLASS CROSS\nRACIAL ORGANIZING SPACES OF\nSOLIDARITY THAT WE SEE IN THE\nCOUNTRY RIGHT NOW. AND THAT'S\nBEEN REALLY POWERFUL IN TERMS OF\nBRINGING EMPLOYERS INTO THE\nMOVEMENT AS WELL AND RECOGNIZING\nTHAT JUSTICE IS NECESSARY FOR\nALL OF US TO HAVE TOGETHER. SO I\nWANT TO TALK A LITTLE BIT ABOUT\nFUTURE WORK THAT IS COMING UP\nFOR THE BOARD. AND WE'VE SHARED\nSOME OF THIS INFORMATION WITH\nCOUNCILMEMBERS THAT WE'VE HAD\nTHE OPPORTUNITY TO MEET WITH IN\nTHE LAST FEW MONTHS BUT THE BIG\nTHING COMING UP IS BACK IN\nNOVEMBER THE BOARD VOTED TO\nRECOMMEND THREE PROPOSED\nAMENDMENTS TO THE ORDINANCE. AND\nOLS IS CURRENTLY WORKING ON\nDRAFTING THOSE AMENDMENTS AND\nOUR HOPE IS THAT THOSE\nAMENDMENTS WILL BE APPROVED BY\nCOUNCIL AT SOME POINT IN 2026.\nSO THE FIRST OF THOSE AMENDMENTS\nIS TO MANDATE WRITTEN AGREEMENTS\nBETWEEN EMPLOYERS AND WORKERS.\nAND THIS REFLECTS A REAL SHIFT\nIN WHAT WORKERS WANT AND WHAT\nHAS BEEN CONSIDERED BEST\nPRACTICE SINCE THE ORIGINAL\nORDINANCE WAS DRAFTED. AT THAT\nTIME A LOT OF WORKERS\nPARTICULARLY ONES WHO WERE\nFEARFUL ABOUT IMMIGRATION STATUS\nWERE CONCERNED ABOUT HAVING A\nREQUIREMENT FOR PARTICULARLY\nWRITTEN CONTRACT AND THAT COULD\nINVOKE FEAR FOR PEOPLE. BUT OVER\nTHE YEARS WHAT WE HAVE SEEN IS\nTHAT WORKERS REALLY HAVE COME TO\nBELIEVE THAT THE BENEFITS OF\nHAVING WRITTEN AGREEMENTS AND\nTHE TERMS OF THEIR WORK\nFORMALIZED WITH THEIR EMPLOYER\nOUTWEIGH ANY ANY POTENTIAL RISK\nTHAT COMES FROM THAT\nDOCUMENTATION. AND SO THERE IS\nSTRONG AGREEMENT NOW AMONG\nWORKERS THAT THE ORDINANCE\nSHOULD BE AMENDED TO INCLUDE\nWRITTEN AGREEMENTS. IT THE\nSECOND AMENDMENT WHICH REALLY\nCOMES OUT OF SOME OF THE\nEXPERIENCE THAT OLS HAS HAD ON\nTHE ENFORCEMENT SIDE WOULD\nREQUIRE EMPLOYERS TO MAINTAIN\nRECORDS OF HOURS WORKED. AND\nOBVIOUSLY THIS IS SOMETHING THAT\nMOST WORKERS AND MOST SECTORS\nTAKE FOR GRANTED. THAT THERE IS\nGOING TO BE A RECORD OF TIME\nSHEETS AND HOURS THAT PEOPLE\nHAVE WORKED. BUT THAT IS NOT\nCURRENTLY REQUIRED IN THE\nORDINANCE. AND WHAT THAT HAS\nMEANT IS THAT WHEN THERE ARE\nENFORCEMENT ACTIONS PARTICULARLY\nAROUND WAGE THEFT EMPLOYERS CAN\nJUST DENY THAT THERE IS NO\nRECORD OF THIS AND SO THE WORKER\nHAS NO PROOF THAT THEY ARE OWED\nTHESE HOURS. AND SO THE SECOND\nAMENDMENT IS TO REQUIRE\nEMPLOYERS TO MAINTAIN RECORDS OF\nHOURS WORKED. AND THEN THE THIRD\nAMENDMENT RELATES TO THE\nQUESTION OF PAID TIME OFF WHICH\nIS SOMETHING THAT WE WILL KEEP\nGOING BACK TO. BUT THIS\nAMENDMENT WOULD INCLUDE\nANTI-RETALIATION PROTECTION FOR\nWORKERS WHO USE TIME OFF. MANY\nWORKERS DON'T EVEN HAVE ACCESS\nTO TIME OFF FOR PAID TIME OFF\nBUT WHEN THEY DO OR EVEN IF\nWORKERS WANT TO TAKE UNPAID TIME\nOFF FEAR OF RETALIATION IS ONE\nOF THE THINGS THAT STOPS WORKERS\nFROM DOING THAT. AND SO WE WANT\nTO INCLUDE ANTI-RETALIATION\nPROTECTION. THOSE THREE\nAMENDMENTS ARE IN PROCESS AS\nCOUNCILMEMBER RINCK MENTIONED.\nTHERE ARE TWO LISTENING SESSIONS\nHAPPENING TO GET PUBLIC FEED\nBOOK FEEDBACK AND INPUT ON THOSE\nAND WE HOPE THAT COUNCIL WILL\nTAKE THOSE UP AND PASS THEM\nBEFORE THE END OF 2026. IN SOME CASES THERE ARE\nWORKERS, CLASSIFIED AS W-2\nEMPLOYEES NANNIES WHO WORK MANY\nHOURS FOR A SINGLE EMPLOYER AND\nTHOSE WORKERS ARE COVERED UNDER\nTHE CITY EXISTING ORDINANCE. BUT\nAGAIN, BECAUSE OF THE INFORMAL\nNATURE OF THE WORK, BECAUSE\nEMPLOYERS DON'T OFTEN RECOGNIZE\nTHAT THEY ARE EMPLOYERS IN THE\nWAY WE TYPICALLY THINK OF IT\nWORKERS ARE NOT ACCESSING THAT\nBENEFIT AND SO THERE IS A NEED\nTO DO CONTINUED OUTREACH AND\nEDUCATION ALONG THOSE LINES. BUT\nTHEN THERE ARE SO MANY DOMESTIC\nWORKERS PARTICULARLY THOSE WHO\nWORK A FEW NUMBER OF HOURS FOR\nMANY EMPLOYERS OVER THE COURSE\nOF THE MONTH LIKE HOUSECLEANERS\nAND THOSE EMPLOYERS CURRENTLY\nGENERALLY DON'T HAVE ACCESS TO\nANY KIND OF PAID TIME OFF\nBENEFIT AND THAT IS GOING TO\nREQUIRE CREATIVITY AND\nINNOVATION, LOOKING AT THINGS\nLIKE A PUBLICLY MANAGED FUND TO\nPROVIDE PAID TIME OFF BENEFIT.\nAND OLS PUBLISHED TWO REPORTS AT\nTHE END OF LAST YEAR THAT GO\nINTO A LOT MORE DETAIL ABOUT\nPASSABLE PATH FORWARD FOR\nEXPANDING PTO ACCESS TO DOMESTIC\nWORKERS.
